When you create an DealShaq account or use DealShaq, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from further using the app, accessing our website, or using any other services provided by DealShaq Technologies Inc.
If you access or download DealShaq from (1) the Apple App Store, you agree to any Usage Rules set forth in the App Store Terms of Service; and/or (2) the Google Play Store, you agree to the Android, Google Inc. Terms and Conditions including the Google Apps Terms of Service.
We, DealShaq Technologies Inc, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page and notify you through the app and/or the email address you provided when you created your account. Any changes to these Terms of Service will take effect immediately from the date of publication.

Limitations of Use
By using DealShaq and our website, you warrant on behalf of yourself, any entity who you represent who has entered into these Terms of Service, and your users that you will not:
• modify, copy, prepare derivative works of, decompile, or reverse engineer DealShaq or any materials and software contained within DealShaq or on our website;
• remove any copyright or other proprietary notations from DealShaq or any materials and software contained within DealShaq or on our website;
• transfer DealShaq or any of its associated materials to another person or “mirror” the materials on any other server;
• knowingly or negligently use DealShaq or any of its associated services in a way that abuses or disrupts our networks or any other service DealShaq Technologies Inc provides;
• use DealShaq or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
• use DealShaq or its associated services in violation of any applicable laws or regulations;
• use DealShaq to send unauthorized advertising or spam;
• harvest, collect, or gather user data without the user’s consent; or
• use DealShaq or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

DealShaq Technologies Inc and its licensors own all rights, titles, and interests in and to the DealShaq services, including all associated intellectual property rights. The service, including its underlying software, databases, interfaces, and related content, is protected by copyright, trademarks, patents, and other intellectual property laws. Users are granted a non-exclusive, non-transferable, revocable license to access and use the DealShaq services strictly for personal, non-commercial purposes as outlined in these Terms.
You may not copy, modify, distribute, sell, or create derivative works from any part of the service without explicit permission from DealShaq Technologies Inc. Any unauthorized use of the DealShaq Technologies Inc content or trademarks is a violation of our intellectual property rights and can lead to legal action. Users are encouraged to report any suspected infringement of intellectual property rights to DealShaq Technologies Inc for immediate review and response.
Delivery Services
DealShaq Technologies Inc provides a platform for facilitating the delivery of groceries ordered through the app from local grocery stores to your doorstep. Delivery services are conducted by third-party providers who operate independently of DealShaq Technologies Inc. As a user, you acknowledge that DealShaq Technologies Inc acts solely as a facilitator and is not directly involved in the actual delivery or logistics. Deliveries are subject to availability of the third-party providers and may vary by location.
When you place an order, you agree to abide by the terms set forth by the third-party delivery provider, including delivery scheduling, locations served, and potential delivery fees. DealShaq Technologies Inc strives to ensure timely delivery; however, occasional delays may occur due to factors beyond our control, such as weather conditions or logistical challenges. In such cases, DealShaq Technologies Inc will provide timely communication and work diligently to resolve any issues.
User Conduct
Users of the DealShaq platform are expected to conduct themselves in a respectful and lawful manner at all times. This includes adhering to all applicable laws and regulations related to online commerce and not engaging in any fraudulent activities or misuse of the service. You are responsible for all activity conducted through your account and must report any unauthorized use of your account to DealShaq Technologies Inc immediately.
Inappropriate behavior, including the posting of offensive content, harassment of other users, or the use of the service for unlawful purposes, is strictly prohibited. DealShaq Technologies Inc reserves the right to suspend or terminate your account if you engage in conduct that is deemed harmful to the service, other users, or any third parties. All users are encouraged to report any suspicious or inappropriate activities to DealShaq Technologies Inc, which will investigate and take appropriate action.
Retailer Partnership Terms
Upon entering into a partnership with DealShaq Technologies Inc, grocery retailers agree to comply with all applicable local, state, and federal regulations concerning food safety, consumer protection, and fair pricing. Retailers are obligated to ensure that all product listings on the DealShaq platform are accurate, including detailed descriptions, pricing information, and clear indications of any applicable restrictions such as minimum age requirements for purchase or geographic limitations.
Retailers are responsible for maintaining the quality of their goods, ensuring that all items meet relevant health and safety standards. Any perishable goods must be stored and transported according to industry best practices to maintain their integrity upon delivery. Failure to comply with these standards may result in the suspension of the retailer’s account and removal of their listings from the platform.
Retailers will be subject to a commission rate as outlined in their individual partnership agreements, which typically include details on payment processing and settlement periods. DealShaq Technologies Inc will deduct a predetermined percentage from the sales price of each transaction as commission. Retailers will receive net payments on a weekly or monthly basis, as agreed upon. Additionally, DealShaq Technologies Inc provides analytical support to retailers through access to sales performance data and market trends, enabling them to optimize their offerings on the platform.
User Registration and Responsibilities
To access and use DealShaq services, individuals must register and create a personal account by providing truthful, accurate, and complete information as prompted by the registration form. Each user is allowed to maintain only one account. Users must ensure that their account information remains current and accurate at all times. It is imperative for users to safeguard their account details and maintain the confidentiality of their passwords. Users are responsible for all activities that occur under their accounts and must monitor their accounts to prevent unauthorized access. Any unauthorized use or security breach must be reported to DealShaq Technologies Inc immediately.
The service is available only to individuals who are at least 18 years of age. DealShaq Technologies Inc reserves the right to refuse service, terminate accounts, or remove or edit content at its sole discretion, ensuring that the platform remains secure and that all interactions comply with legal standards. This approach helps maintain a safe and reliable environment for all users and transactions on the platform.
When placing orders, users must adhere to the terms set by individual retailers, including compliance with pricing and sale conditions. Users are responsible for ensuring that the delivery address provided is correct and secure and must be available to receive their orders as scheduled. Failure to meet these conditions may result in missed deliveries, for which DealShaq Technologies Inc and the affiliated retailers are not liable.
DealShaq Technologies Inc provides a structured mechanism for resolving disputes between shoppers and retailers. Should issues arise related to product quality or discrepancies in service, users are encouraged to report these through the platform. DealShaq Technologies Inc facilitates initial resolution efforts directly with the retailer. If a satisfactory resolution is not achieved, DealShaq Technologies Inc will intervene to mediate and, if necessary, assist in processing refunds or returns in accordance with the retailer’s published policies and applicable laws.
Ordering and Transactions
When placing an order through the DealShaq app, you are effectively making an offer to purchase products from selected local grocery stores under the terms and prices indicated for those products. Each order you place will constitute a separate transaction and will be subject to the specific terms and conditions provided in these Terms of Service.
DealShaq serves as a facilitator between you and the Partner Retailer; thus, the actual contract for the sale of goods is established directly between you and the retailer. By using the service, you authorize DealShaq Technologies Inc to act as your limited agent for purposes such as processing payments, handling returns, and managing transaction-related operations. However, it is important to note that DealShaq Technologies Inc does not assume liability for the goods sold by Partner Retailers.
As part of your transaction, you agree to pay all applicable fees and charges described in DealShaq’s fees and billing terms in effect at the time of the transaction. This includes any taxes applicable to your purchase. Prices for products offered via the service may occasionally differ from those available in-store, reflecting the distinct dynamics of online shopping and logistical considerations.
Alcohol Sales and Delivery Terms
DealShaq Technologies Inc permits the ordering of alcoholic products in certain locations from specified retailers through its app. Users must comply with all applicable laws and ensure that neither DealShaq Technologies Inc nor any third-party providers, including retailers, contravene these laws. Users affirming they are of legal drinking age, which is 21 years or older in the United States, may order alcoholic products. Upon delivery, the recipient must present valid government-issued identification, which the delivery personnel may scan to verify age and require a signature. Recipients must not be intoxicated at the time of delivery. DealShaq Technologies Inc reserves the right to cancel any alcohol-related orders if the recipient cannot provide suitable identification or if any legal requirements are unmet. No requests for alcohol substitutions or special orders outside the catalog offerings will be honored.
Prescription Drug Delivery Terms
DealShaq Technologies Inc facilitates the ordering of prescription drug products through its app. It is crucial to understand that DealShaq is not a pharmacy and does not endorse any specific pharmacies for prescription processing. Users are solely responsible for selecting the pharmacy that dispenses their medications. Upon delivery, the recipient must show valid government-issued identification, which the delivery personnel may scan. Users must ensure that prescription drugs are not purchased for resale or provided to individuals other than the intended recipient prescribed by a healthcare professional. Users are advised to consult directly with healthcare providers for any medical advice or concerns. DealShaq Technologies Inc explicitly states that it does not provide medical advice or engage in any pharmacy-patient or physician-patient relationships.
Automatic Updates
You give us permission to download and install updates to DealShaq on your device in accordance with your privacy preferences. This permission can be revoked at any time by deleting DealShaq from your device.
Disclaimer and Limitations of Liability
DealShaq Technologies Inc provides the DealShaq app and its associated services on an “as is” and “as available” basis, without any warranties, express, implied, or statutory. We specifically disclaim any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement. Continuous, uninterrupted access to our services is not guaranteed, and operation of the DealShaq app and website may be affected by factors outside of our control.
In no event will DealShaq Technologies Inc, its directors, officers, employees, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages arising from or connected to your use of the DealShaq app or any services provided by DealShaq Technologies Inc. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, whether based in contract, tort (including negligence), strict liability, or otherwise.
Our liability related to any purchase made through our platform is strictly limited to the purchase price of the product. DealShaq Technologies Inc is not responsible for product defects, mislabeling, or other issues related to the quality and safety of goods sold. Such responsibilities lie with the individual retailer partners, including compliance with health and food safety regulations. Any disputes arising from the use of DealShaq services are to be addressed through our customer support, aiming for resolution in a timely and equitable manner. Users are encouraged to engage our dispute resolution processes for assistance with any concerns.
The above disclaimers, exclusions, and limitations of liability do not apply universally as some jurisdictions do not allow exclusions of certain warranties or limitations of liability for incidental or consequential damages. Therefore, the limitations above may not apply to every user.

Notice regarding Apple
To the extent that you are using or accessing DealShaq on an iOS device, you acknowledge and agree to the terms of this clause. You acknowledge that these Terms of Service are between you and DealShaq Technologies Inc only, not with Apple Inc. (Apple), and Apple is not responsible for DealShaq and any materials available in DealShaq.
Apple has no obligation to furnish you with any maintenance and support services with respect to DealShaq.
If DealShaq fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the mobile application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to DealShaq and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our responsibility.
Apple is not responsible for addressing any claims by you or any third party relating to DealShaq or your use of DealShaq, including but not limited to (1) product liability claims; (2) any claim that our mobile application fails to conform to any applicable legal or regulatory requirement; and (3) claims arising under consumer protection or similar legislation.
Apple is not responsible for the investigation, defense, settlement and discharge of any third-party claim that our mobile application infringes that third party’s intellectual property rights.
You agree to comply with any applicable third-party terms when using DealShaq, including any Usage Rules set forth in the Apple App Store Agreement of Service.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms of Service and, upon your acceptance of these Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Service against you as a third-party beneficiary of these Terms of Service.
You hereby represent and warrant that (1) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a ‘terrorist supporting’ country; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties.
Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your contributions; (2) use of the app; (3) breach of these Terms of Service; (4) any breach of your representations and warranties set forth in these Terms of Service; or (5) your violation of the rights of a third party, including but not limited to intellectual property rights.
Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
Right to Terminate
We may suspend or terminate your DealShaq account and right to use DealShaq and these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.
Severance
Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.
Entire Agreement
These Terms of Service and any policies or operating rules posted by us on the website or with respect to the website or app constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Service shall not operate as a waiver of such right or provision. These Terms of Service operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.
If any provision or part of a provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Service and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms of Service or use of the app. You agree that these Terms of Service will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Service and the lack of signing by the parties hereto to execute these Terms of Service.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Virginia. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location for the resolution of any disputes arising from or related to these Terms of Service or your use of the DealShaq Technologies Inc services.
Dispute Resolution and Arbitration Agreement
To ensure efficient and fair resolution of disputes, DealShaq Technologies Inc adopts a two-tiered process: initially, an informal dispute resolution directly with DealShaq Technologies Inc is required, followed by formal resolution through binding arbitration if necessary. While arbitration serves as the primary method for dispute resolution, both parties retain the right to seek resolution in small claims court as an alternative, provided the claims qualify for such proceedings.
DealShaq Technologies Inc believes in the value of resolving disputes amicably and efficiently outside of formal proceedings. Therefore, before initiating arbitration or litigation, both parties agree to first attempt to resolve any disputes informally. The party initiating the dispute must send a written notice to DealShaq Technologies Inc detailing the nature and basis of the dispute, along with the specific relief sought. This notice should provide sufficient details to facilitate an understanding of the issue and include contact information for further communication. The parties agree to a 60-day period to resolve the dispute amicably before proceeding to arbitration.
Should disputes not be resolved informally, DealShaq Technologies Inc and the user agree to submit any remaining disputes to binding arbitration, rather than pursuing court action. This agreement to arbitrate includes, but is not limited to, disputes arising out of or related to the use of DealShaq Technologies Inc services, transactions processed through DealShaq Technologies Inc, and any other aspects of the user’s relationship with DealShaq Technologies Inc. The arbitration will be conducted under the rules of a recognized arbitration association and managed by a neutral arbitrator whose decision will be considered final and binding. Both parties agree that any arbitration will occur in the state of Virginia, adhering to the legal standards set forth under federal law or, where applicable, the laws of Virginia.
Both parties retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party’s intellectual property rights. Furthermore, if a dispute qualifies for small claims court, either party may choose to pursue that avenue as an alternative to arbitration, subject to the court’s approval. This streamlined dispute resolution approach minimizes the complexities and legal overhead, aligning with DealShaq Technologies Inc’s commitment to providing a user-friendly, accessible service environment.
